TURKISH JUSTICE ACADEMY STAFF Promotion

AND TITLE CHANGE REGULATION

FIRST PART

Purpose, Scope, Basis and Definitions

Goal

ARTICLE 1 - (1) The purpose of this Regulation; Within the framework of merit and career principles, to determine service requirements and planning staff Turkey on the basis of principles and procedures concerning the promotion and title change to dismiss staff who work in the Justice Academy.

Scope

ARTICLE 2 - (1) These Regulations, dated 14/7/1965 Justice Academy of Turkey and 657 from the Academy staff who work according to the law, the tasks specified in Article 5, will be appointed by mission includes promotion and title change.

Rest

ARTICLE 3 - (1) These Regulations, dated 14/7/1965 and the Civil Servants Law No. 657, dated 2 and published in the Official Gazette No. 5 on No. 2019 with the Justice Academy of Turkey Article 30762 of Presidential Decree 34/15/15 It has been prepared on the basis of the provisions of the General Regulation on the Principles of Promotion and Title Change in Public Institutions and Organizations, which was put into effect by the Cabinet Decree dated and numbered 3/1999.

Definitions

ARTICLE 4 - (1) In this Regulation;

a) The Academy: Justice Academy of Turkey,

b) Academy staff: Those who work in the academy cadres subject to Law No. 657

c) Sub-task: Duties in a lower hierarchy within the framework of the hierarchical levels specified in Article 10 of the Presidential Decree No. 7 on the Presidential Organization, published in the Official Gazette dated 2018/30474/1 and numbered 509,

ç) Task at the same level: Duties in the same group or in the same subgroup if there are subgroups within the group in terms of hierarchy, duty, authority and responsibility,

d) The President: The President of the Justice Academy of Turkey,

e) The Chairman: Chairman of the Justice Academy of Turkey,

f) Department chief department heads who served in the Justice Academy of Turkey,

g) Task groups: Groups with same level tasks and similar tasks,

ğ) Promotion: Appointments to be made from the same or other service classes from the posts subject to Law No. 657 to the posts listed in Article 5,

h) Promotion exam: The written and oral exam to be subjected to those who will be appointed by promotion,

ı) Service period: terms calculated within the framework of subparagraph (B) of Article 657 of Law No. 68,

i) Business day: Other days, excluding national holidays, general and weekend holidays,

j) Examination board: The board to be established by the President to carry out the studies regarding promotion and title change exams,

k) Change of title: Appointments made to positions related to titles granted as a result of vocational or technical education at at least secondary education level, while working in another position,

l) Title change exam: The written and oral exam to be subjected to those who will be appointed by title change,

m) Senior duty: Duties in a higher hierarchy within the framework of the hierarchical levels specified in Article 1 of the Presidential Decree No. 509,

SECOND PART

Basis for Promotion and Title Change

Task groups

ARTICLE 5 - (1) The positions subject to promotion and title change within the scope of this Regulation are stated below.

(2) Service groups subject to promotion are as follows:

a) Management services group:

1) Branch manager.

2) Protection and security chief.

b) Research, planning and advocacy services group:

1) Expert and civil defense specialist.

c) Administrative services group:

1) Treasurer.

2) Data preparation and control operator, computer operator, officer, property officer, cashier, secretary, protection and security officer, driver.

ç) Auxiliary services group:

1) Servant.

(3) The positions subject to title change are:

a) Lawyer, translator, psychologist, social worker, librarian, programmer, technician, graphic designer.

General conditions to be sought for those who will be appointed by promotion

ARTICLE 6 - (1) The following general conditions are sought in appointments to be made by promotion:

a) To be successful in the written and oral exam for promotion.

b) To have the terms of service specified in subparagraph (B) of Article 657 of Law No. 68.

c) To have been working in the Academy for at least one year, except for the absence of personnel meeting this requirement for the announced staff.

Special conditions to be sought in those who will be appointed by promotion

ARTICLE 7 - (1) In addition to the general conditions, the following special conditions are sought in order to be appointed to the titles listed in the second paragraph of Article 5 by promotion:

a) In order to be appointed to the branch manager, civil defense expert and expert staff;

1) To be a graduate of at least a four-year college, faculty or school of justice, the justice department of the vocational schools or the associate degree program of justice vocational education,

2) Having at least six years of service in the cadres of protection and security chief, officer, property officer, cashier, technician, data preparation and control operator, computer operator, librarian, accountant and programmer for the last one year at the Academy,

b) In order to be appointed to the protection and security chief positions;

1) To be a graduate of at least two years of higher education,

2) Having worked as a guard and security officer for at least two years, the last year being at the Academy,

c) In order to be appointed to the accountant staff;

1) To be a graduate of at least a four-year faculty or college,

2) Having served for at least five years, the last year being in the Academy,

ç) In order to be appointed to the positions of computer operator, data preparation and control operator, cash officer, cashier;

1) To be at least a secondary school graduate,

2) Having graduated from the computer department of faculties / colleges, the justice college, the justice department of the vocational schools, the justice associate degree program, the justice vocational high school or from the trade or computer departments of other high schools or equivalent schools, or at least a high school or equivalent school graduate, Having a typewriter or computer certificate approved by the Ministry of Education or given as a result of courses organized by public institutions and organizations,

3) Having worked as an attendant for at least two years, the last year being in the Academy,

d) In order to be appointed to the secretary staff;

1) To be at least a secondary school graduate,

2) Having worked as an attendant for at least two years, the last year being in the Academy,

e) In order to be appointed to the protection and security staff;

1) To meet the conditions specified in the Law No. 10 dated 6/2004/5188 on Private Security Services,

2) Having worked as an attendant for at least two years, the last year being in the Academy,

f) In order to be appointed to the driver's staff;

1) To be at least a secondary school graduate,

2) To have a driver's license in the class to be specified in the exam announcement,

3) Having worked as an attendant for at least two years, the last year being in the Academy,

must.

General conditions to be sought for those who will be appointed through title change

ARTICLE 8 - (1) The following general conditions are sought in appointments to be made through title changes:

a) Title change to be successful in the written and oral exam.

b) To have the terms of service specified in subparagraph (B) of Article 657 of Law No. 68.

c) Working at the academy.

Special conditions to be sought for those who will be appointed through title change

ARTICLE 9 - (1) In addition to the general conditions, the following special conditions are sought in the appointments to be made to the positions specified in the third paragraph of Article 5 by changing the title:

a) In order to be appointed to the lawyer staff;

1) To have a lawyer's license,

b) In order to be appointed to the staff of translators;

1) To be graduated from philology, translation and translation departments of faculties or four-year colleges or other related departments,

2) To be successful in the Foreign Language Placement Exam at least (B) level within the last 5 years as of the last day of the application or to have an internationally valid document accepted by the Presidency of the Assessment, Selection and Placement Center in terms of language proficiency,

c) In order to be appointed to the programmer staff;

1) To be graduated from faculties / colleges that provide computer programming education or to have a computer programmer certificate approved by the Ministry of National Education or a computer programmer certificate obtained from courses or higher education institutions approved by the Ministry of National Education, for those who have graduated from other faculties / schools,

2) To know the programming language or languages ​​to be specified in the exam announcement,

ç) In order to be appointed as librarian, social worker, psychologist;

1) Having graduated from the relevant departments of at least four-year higher education institutions,

d) In order to be appointed to the graphic designer;

1) Graduating from the graphic or design departments of faculties or schools,

e) In order to be appointed to the technician staff;

1) Having graduated from the departments of vocational or technical education at least high school equivalent schools,

THIRD PART

Promotion and Title Change Examination Principles, Appointment

Announcement and application

ARTICLE 10 - (1) The positions to be appointed by promotion and title change are announced on the Academy website at least one month before the written exam. The application period is determined as at least five working days.

(2) In this announcement;

a) The class, title, degree and number of the staff to be appointed,

b) Conditions to be sought in the application,

c) Place and place of application,

ç) Starting and ending dates of the application,

d) Written exam topics and other relevant issues,

It is shown.

(3) Personnel with the qualifications required as of the last day of the application date determined for the announced positions can apply for only one of the different titles for which the application conditions meet, as specified in the announcement.

(4) Including those who take unpaid leave, those who use the permissions granted in accordance with the relevant legislation are also allowed to take the exam.

(5) Applications made to the Academy are examined by the examination board and those who meet the required conditions are announced on the Academy's website.

Written examination

ARTICLE 11 - (1) The written exam for promotion is prepared by the Academy on the following subjects, by including the topics of this exam in the announcement:

a) The Constitution of Turkey:

1) General principles.

2) Basic rights and duties.

3) Basic organs of the state.

b) Ataturk's Principles and Revolution History, national security.

c) Legislation on state organization.

ç) Law No. 657 and relevant legislation.

d) Rules regarding Turkish grammar and correspondence.

e) Public relations.

f) Ethical principles of behavior.

g) The structure and duties of the academy and the judicial organization, the National Judicial Network Information System, the Public Financial Management and Control Law No. 10 dated 12/2003/5018 and other issues related to the nature of the task to be assigned.

(2) The title change written exam includes the issues related to the field of duty of the Academy and the nature of the assignment.

(3) Written exams can be done by the Academy or by the Presidency of the Assessment, Selection and Placement Center, the Ministry of National Education or one of the higher education institutions. In case of taking exams;

a) Procedures for conducting written exams are determined by a protocol to be prepared in accordance with the provisions of this Regulation and general provisions.

b) The provisions of the relevant legislation are applied for all kinds of exam fees and other payments related to the exam to be requested by the examiners.

(4) Written exam is evaluated over a hundred points. Those who score at least sixty points in the written exam are considered successful.

(5) Those who will participate in the title change written exams are not required to have served for a certain period of time in the Academy or in positions unrelated to their educational status.

Oral examination

ARTICLE 12 - (1) Starting from the candidate with the highest score in the written exam, five times the number of the announced staff is taken to the oral exam. All candidates who have the same score as the last candidate are taken to the oral exam.

(2) The relevant candidate, by each member of the examination board;

a) Level of knowledge on exam subjects (25 points),

b) Ability to comprehend and summarize a subject, ability to express and reasoning (15 points),

c) Merit, representation ability, suitability of attitudes and behaviors for duty (15 points),

d) Self-confidence, persuasion and persuasiveness (15 points),

d) General culture and general ability (15 points),

e) Openness to scientific and technological developments (15 points),

on the basis of a hundred points.

(3) The oral exam score of the personnel is determined by taking the arithmetic average of the points given by each member.

(4) Those who get at least XNUMX points out of a hundred in the oral exam are considered successful.

Examinations for people with disabilities

ARTICLE 13 - (1) Necessary measures are taken or ensured to be taken in order to conduct the examinations of the disabled persons who meet the conditions related to the duties listed in this Regulation and who are able to perform the task to be appointed.

Success ranking

ARTICLE 14 - (1) Achievement score is taken as basis in assigning the number of vacancies announced by promotion and title change.

(2) Success score is determined based on the arithmetic average of the written and oral exam scores and announced on the Academy's website.

(3) If success scores are equal, respectively;

a) Those with a longer service life,

b) Those who have completed their higher education,

c) For those with higher education graduation grades,

by giving priority, the success sequence is determined starting from the highest score.

(4) Among the personnel who cannot be appointed due to the announced number of positions, even though they are successful in the promotion and title change exam, the maximum number of actual candidates can be determined as substitute in the success ranking list if needed.

Examinations invalid

ARTICLE 15 - (1) Those who cheat in the exams, those who cheat or attempt to do so, and those who put an indicative mark on the exam papers are removed from the exam hall and the exam papers are deemed invalid with a written report. In addition, disciplinary superiors are reported to be disciplined against these persons.

(2) On the basis of the exam entry document, the exams of those who are found to have made false statements in the application form filled in by the candidates or who are found to not meet the required conditions are considered invalid. The appointments of those who have been appointed are canceled.

(3) If it is understood that instead of the candidate who will take the exam, another person took the exam, the situation is determined with a report and the exam of the candidate is considered invalid. Legal action is taken against those concerned.

(4) No one can enter the exam hall except the personnel who are taken to the exam, the supervisors and members of the exam board.

Disclosure of the results of the examination and appeal

ARTICLE 16 - (1) Exam results are announced on the Academy's website. Those concerned may object to the written exam results within five working days after the announcement by stating their reasons. Objections are examined by the examination committee within ten working days at the latest, and the results are notified to those who object by the institution conducting the examination. The decisions made by the examination board upon objection are final.

(2) Written exam questions found to be incorrect are deemed to have been answered correctly in terms of all candidates participating in the exam.

ARTICLE 17 - (1) Personnel who are entitled to be appointed are assigned according to their success scores in the success ranking, starting from the highest score within three months following the finalization of the success ranking list.

(2) Of the announced staff;

a) the exams are invalid or the appointments are canceled because they do not have the conditions of appointment;

b) Retirement, death, withdrawal or dismissal from civil service, appointment to other titles or to another institution,

Those who are vacant or vacant due to reasons may be appointed from the substitutes according to their success ranking, if determined, until the announcement of the next exam for the positions with the same title, not exceeding the six-month period from the date of finalization.

(3) Those who do not participate in the promotion exam for any reason, and those who are unsuccessful or those who have not been appointed from the substitutes until the announcement regarding the next exam within six months, or those who renounce their right of appointment for any reason, are subject to all procedures and principles stipulated in this Regulation for appointments to the same titled positions.

Storage of examination documents

ARTICLE 18 - (1) The documents related to the exams of those who are successful in the exams are kept in the personal files of the relevant persons, and the documents of those who fail are kept in the archive of the Academy until the next exam for the same title, provided that it is not less than the time of filing a lawsuit.

Exam board and its duties

ARTICLE 19 - (1) Exam board; conducts examinations, announcement of exam results, finalization of objections and other tasks related to exams.

(2) Exam board; It consists of five members, with four members to be determined by the President from among the review judges assigned in the Academy, under the chairmanship of the President or, if appointed, by the Head of Human Resources and Support Services Department. In addition, with the same procedure, four substitute members are determined to participate in the examination committee in the absence of permanent members.

(3) The members of the examination board cannot be inferior to the personnel to be taken for promotion and title change exam in terms of their education and the titles they have earned, except for graduate education.

(4) In the event that it is determined that the chairman and spouses of the examination committee and their relatives by blood and in-law (including this degree) attend the examination for promotion or title change, such member or members cannot participate in the membership of the examination board and one of the substitute members is appointed.

(5) The exam board convenes with the total number of members. Decisions are taken by majority vote. Abstaining votes cannot be used in voting. Substitute member attends the meeting where the main member cannot attend. Those who voted against state their reasons in the decision.

(6) The secretariat procedures of the examination board are carried out by the Human Resources and Support Services Department.

Transitions between task groups

ARTICLE 20 - (1) Transitions between the task groups specified in Article 5 are made within the framework of the following principles:

a) Transitions that qualify as promotion between job groups and from lower groups to upper groups are subject to promotion examination.

b) Those who are in the sub-task group of the same main task group may be appointed to other positions without being subjected to a promotion examination, provided that they remain within the same sub-group and meet the conditions required by the staff to be appointed.

c) Upon the request of the personnel, appointments can be made to positions previously held at the academy or other public institutions and organizations, to positions of the same level as these positions or to lower positions without being subjected to a promotion examination.

ç) The positions subject to title change and the transfers between these positions are made according to the results of the title change exam held for the relevant staff. However, the staff of the Academy who have completed their doctorate education can be assigned to tasks that have been allocated through education without participating in the title change exam.

d) The staff of the Academy, who have completed their doctorate education, can be appointed to specialist or lower positions with positions at the same level with this title, provided that they meet the terms of service and education.

Direct assignment

ARTICLE 21 - (1) Appointments without examination can be made to the titles subject to this Regulation from the same titles in other public institutions and organizations or from other titles at the same or higher level with these titles, provided that they meet the conditions required in the legislation, such as education and certificate requirement and service period, according to general provisions.

CHAPTER FOUR

Miscellaneous and Final Provisions

Circumstances without provision in the regulation

ARTICLE 22 - (1) In cases where there is no provision in this Regulation, the provisions of the Regulation on the Principles of Promotion and Title Change in Public Institutions and Organizations are applied.

Repealed regulation

ARTICLE 23 - (1) Official Gazette No. 19 dated 10 published in Turkey Justice Academy Staff Promotion and Change of Title of the Regulation is repealed.

Level of education

PROVISIONAL ARTICLE 1 - (1) Those who were on duty on 18/4/1999 and graduated from two or three years higher education as of the same date are deemed to have completed a four-year higher education in terms of the implementation of this Regulation, if they meet other conditions.

Force

ARTICLE 24 - (1) This Regulation shall enter into force on the date of its publication.

Executive

ARTICLE 25 - (1) These Regulations are enforced by the Chairman of the Justice Academy of Turkey.
