Used mobile phones and tablets can be sold with warranty documents as "renewed product" after they are renewed, certified and packaged. The "Regulation on Sale of Renewed Works" of the Ministry of Commerce entered into force after being published in the Official Gazette.
With the regulation, the ways and bases for the renewal, certification and resale of used mobile phones and tablets are arranged.
Accordingly, used goods can be renewed by the renewal centers in accordance with the regulations determined by the Ministry or the standards set by the Turkish Standards Institute. Renewed used goods can be put on the market again as "renewed product" after they are certified and packaged.
The used goods can be picked up from the consumer by the authorized buyer and transferred to the renewal center or by the renewal center directly from the consumer.
In order for mobile phones to be renewed, they must have been used for at least one year and there must be data traffic.
The packaging will contain the phrase "renewed product".
In the packaging, label, advertisements and announcements of the renewed work, it will be required to include the phrase "renewed product" and the information of the renewal center in a way that the consumer can quickly perceive it.
While the renewal process is being carried out, the phrase "renewed product using manufacturer approved cuts" will also be included if all the renewed sections are the producer or the importer approved sections authorized by the producer.
Guarantee will be mandatory
It was obligatory to offer the renewed work for sale with a "renewed work guarantee". The responsibility for the preparation of the renewed work guarantee commitment will be on the renewal center, and the burden of giving it to the consumer and proof of delivery will be on the authorized dealer.
The renewed work guarantee can be given in writing or with a permanent data storage. The authorized dealer and the renewal center will be jointly responsible for the warranty and after-sales services for maintenance, repair and assembly to be given within the warranty period.
In cases where the used goods are renewed by the manufacturer or importer or by the renewal center with the approval of the manufacturer or importer of the renewal process, the guarantees provided by the manufacturer or importer will remain valid.
To be sold with Turkish introduction and user manual
The renewed work will be available for sale with a Turkish introduction and user manual. The responsibility for the preparation of the Turkish introduction and user manual will be on the renewal center, and the burden of giving it to the consumer and proof of delivery will be on the authorized dealer. Turkish introduction and user manual can be given in writing or with permanent information storage.
The authorized buyer and the authorized dealer will be able to serve more than one renewal center, provided that they obtain another separate authorization.
Renewal authorization document will be valid for 5 years
The regulation also includes information on the establishment, application and permits of renewal centers and the rules sought in granting renewal authorization documents. Accordingly, renewal centers will have to obtain a "renewal authorization certificate" approved by the Ministry of Commerce.
In order to obtain the renewal authorization document, the condition of "having a service place qualification document in accordance with the regulation or standards determined by the Ministry or TSE" will be sought. The validity period of this document will be 5 years and will have to be renewed before the validity period expires.
In the regulation, the responsibilities of the authorized buyer, the renewal center and the authorized dealer were separately included, the details of the renewed work guarantee and after-sales services were listed.
Minister Pekcan had announced
