TRAIN MACHINE REGULATION

FIRST PART

Purpose and Scope, Basis and Definitions

Purpose and scope

ARTICLE 1 - (1) The purpose of this Regulation; To determine the procedures and principles regarding the minimum professional competencies, health conditions, working hours and the documents required to have the train mechanic to perform his duty safely.

(2) This Regulation covers train machinists who conduct traction and management of traction vehicles on the national railway infrastructure network.

(3) This Regulation;

a) People who carry out train transportation and administration in the city rail public transportation systems such as suburban, metro and tram independent from the national railway infrastructure network,

b) People who are independent from the national railway infrastructure network and who carry out train management and administration on the railway infrastructures established to meet the internal cargo transportation needs of a particular enterprise or institution,

c) Persons carrying train management and administration for amusement park, museum exhibition, demonstration and similar purposes independent of national railway infrastructure network,

It does not cover.

ARTICLE 2 - (1) This Regulation; It has been prepared on the basis of subparagraphs (a) and (d) of the first paragraph of Article 26 of the Decree Law on the Organization and Duties of the Ministry of Transport, Maritime Affairs and Communications No. 9 of 2011/655/8.

Definitions

ARTICLE 3 - (1) In this Regulation;

a) Minister: Minister of Transport, Maritime Affairs and Communications,

b) Ministry: Ministry of Transport, Maritime Affairs and Communications,

c) Certification: The activity of the personnel to be determined and documented by an independent institution or organization in writing, in accordance with a specific standard or technical regulation,

ç) Traction vehicle: Any kind of locomotive or automotive, train sets that move with the driving power produced by the engine on it,

d) Serious accident: As a result of a train collision, a detour of the train, a similar incident, the death of at least one person, serious injury to five or more people, a minimum of six million TL in the vehicles, on the road, other facilities and / or environment. accidents that open, similar accidents that clearly affect safety management or safety rules,

e) Railway infrastructure operator: Public legal entities and companies authorized by the Ministry to operate the railway infrastructure in a safe manner and to offer it to the service of railway train operators,

f) Directorate General of Railway Regulatory Affairs: The Ministry's service unit responsible for carrying out the works and operations to be performed by the Ministry within the scope of this Regulation,

g) Railway training and examination center: The institution or organization where the trainings and exams that are authorized by the Ministry, which perform safety critical duties in the railway transportation activities, are applied and the certification is carried out,

ğ) Railway train operator: Public legal entities and companies authorized by the Ministry to carry out cargo and / or passenger transportation on the national railway infrastructure network,

h) Safety management system: The organizational structure that will ensure the safe operation of all operators, systematically determining the measures to reduce hazards and accidents and reduce risks, and accordingly, revise the rules, instructions and processes,

ı) Locomotive: Rail system vehicle that moves with the drive power produced by the engine on it and moves the towed vehicles connected to the front or back with this movement,

i) Copy of certified train driver's license: A document issued by the railway train operator or infrastructure operator, in which the information contained in the train driver's badge is in plain text,

j) Automotris: Moving with the driving power generated by the motor on it, connected to the back and front when necessary, moving the towed vehicles and / or the same zamRail system vehicle that allows passenger or cargo to be carried on it,

k) Drugs and stimulants: Any substance that shows its effect in the central nervous system and causes temporary or permanent changes in perception, mood, consciousness and behavior by changing the functions of the brain,

l) Psychotechnical evaluation: The examination and evaluation method designed to measure the individual's physical and mental characteristics by means of tests, to determine whether the individual is suitable for a particular job in order to reveal the competence of the individual in a particular job,

m) Psychotechnical evaluation center: Psychotechnical evaluation center licensed by the Ministry of Health,

n) Health board report: Board reports received by full-fledged state hospitals and state-owned university hospitals, and board reports issued by other healthcare providers in case of emergency disease or on the basis of operation,

o) Urban rail public transportation systems: subway, tram, suburban and similar rail systems offered to meet transportation needs between a city center or urbanized region provincial and surrounding areas not connected to the national railway network,

d) TCDD: Republic of Turkey General Directorate of State Railways Administration,

p) The Republic of Turkey State Railways TCDD Transportation Inc .: Transport Inc.,

r) Train: The series received by one or more towing vehicles and one or more towed vehicles or one or more towing vehicles,

s) Train mechanic: Within the working time and working rules determined by law, safely, comfortably and economically, occupational health and safety, environment and quality standards and regulations, work instructions, traction vehicles that take the train with the traction vehicles prepared, delivered and shipped. qualified technical person,

ş) Train driver's license: A document proving that a train driver is authorized to drive the train on which railway lines and which traction vehicles to manage and manage,

t) Train driver's license: A document proving that a train driver has the health conditions, psycho-technical and professional qualifications required to do his job safely,

u) Train set: Any passenger train consisting of one or more vehicles, fixed or pre-defined,

Certification of Train Machinist

General considerations

ARTICLE 4 - (1) In order for the train machinist to carry out the management and traction of the traction vehicle, he must have a train machinist license and a train machinist license.

(2) While the train machinist carries out and carries out the traction vehicle, the train mechanic is obliged to keep the driver and license originals with him.

(3) Railway train operators and infrastructure operators are responsible for monitoring and establishing a registration system for the train mechanic he employs or runs under a service contract, and that he has a train driver's license and train driver's license.

THIRD PART

Train Engineer License

Minimum requirements for getting a train driver's license

ARTICLE 5 - (1) The qualifications required by the applicants to obtain the train driver's license are as follows:

a) To have completed the age of twenty on the date of application,

b) To provide at least one of the following formal education conditions:

1) To graduate from one of the rail systems technology field rail systems electrical-electronic, rail systems machinery, rail systems mechatronics branches of secondary education institutions providing vocational and technical education,

2) Two-year vocational schools; to graduate from one of the departments of rail systems electrical and electronic technology, rail systems machinery technology, rail systems road technology, rail systems mechanic, rail systems management, machinery, engine, electricity, electrical-electronics,

3) To graduate from the four-year engineering, rail systems or technical teacher undergraduate program of universities.

c) To have the following documents taken from hospitals no later than sixty days before the application date for the train driver's license:

1) Health board report certifying that it meets the health conditions specified in Annex-1,

2) The report received from the laboratory authorized by the Ministry of Health, that it obtained a "negative" result from the drug and stimulant test,

3) Psychotechnical evaluation report obtained from the psychotechnical evaluation center licensed by the Ministry of Health in accordance with the procedures and principles in Annex-2,

ç) To have successfully completed the train machinist basic training program organized in accordance with the issues specified in Annex-3 from a railway training and examination center, and to have received a certificate of participation,

d) To have received at least 100 (seventy) points out of 70 (hundred) from the proficiency exam applied at a railway training and examination center authorized by the Ministry or the Ministry, at most twelve months before the application date.

Arranging train driver's license

ARTICLE 6 - (1) The authority to organize train driver's license belongs to the Ministry.

(2) Train driver's license is arranged for real people. Its ownership belongs to the real person to whom it is arranged. The organization where the train mechanic works does not have the authority to save on the train driver's license.

(3) Applications for the arrangement of train driver's license can be made individually or by a legal person on behalf of the individual.

(4) The Ministry concludes the procedures regarding the arrangement of the train driver's license within thirty working days at the latest from the date of application.

(5) The Ministry keeps all information about the licenses issued, renewed, suspended or canceled in its own registration system.

Validity of train driver's license and periodical notifications

ARTICLE 7 - (1) The train driver's license is valid for ten years if the periodical notifications specified in this article are made to the Ministry.

(2) The periodical notifications are received by the trainer for the age of forty-five until the age of five, forty-five and fifty-five, and after the age of fifty-two, every two years by himself or his institution, in the last sixty days, in Annex-1. The originals of the specified health and psycho-technical assessment reports specified in Annex-2 are made.

(3) Railway infrastructure or railway train operators ensure that train mechanics are employed to receive renewal training at the intervals specified in the company's safety management system. These trainings are recorded in the company's safety management system. The validity of the license is checked by the Ministry according to these records.

Suspension and cancellation of the train driver's license

ARTICLE 8 - (1) The periodic notifications in Article 7 and / or renewal trainings at intervals determined in the safety management system of the enterprise zamIf it is detected during the inspections to be carried out by the Ministry, the following process is initiated:

a) The Ministry suspends the validity of the license indefinitely by notifying this situation in writing to the license holder and the institution where the license holder works, with the rationale,

b) The train driver, whose license is suspended, cannot be assigned the duty of consignment and administration by the institution he works for,

c) Suspension of the license will cease if the periodic notifications specified in Article 7 are made and / or renewal trainings are made.

(2) The license of the train mechanic is canceled by the Ministry for two years in case it causes serious accident, provided that it is documented by the judicial authorities that it is completely defective. The time taken from the post after the incident occurred is taken into account in this case.

Renewal of the train driver's license

ARTICLE 9 - (1) The train driver's license is renewed by the Ministry in the following cases:

a) Ten years have passed since the date of issue,

b) Lost or stolen license,

c) Damage to the driver's license,

ç) Changing the information on the driver's license,

d) Cancellation of the driving license.

(2) The Ministry concludes the procedures related to the renewal of the train driver's license within three working days from the date of application.

(3) Documents required for the renewal of the train driver's license are:

a) Application petition,

b) A valid medical board report and psychotechnical evaluation report,

c) Original of the train driver's license if it is not lost,

ç) Two photographs,

d) A document showing that the train driver's license fee has been paid.

Train driver's license fee

ARTICLE 10 - (1) For each train driver license to be arranged and renewed by the Ministry, the fees specified in Annex-4 are charged.

(2) Train driver's license fees are applied by increasing the revaluation rate determined and announced in accordance with the Tax Procedure Law dated 4/1/1961 and numbered 213 for that year, valid from the beginning of each calendar year.

(3) The train driver's license fee is deposited into the Ministry Revolving Fund Enterprise Accounting Unit account.

CHAPTER FOUR

Train Machinist Badge

General points about train driver's badge

ARTICLE 11 - (1) The train mechanic badge is arranged by the infrastructure operator or the train train operator, where the train mechanic works, in accordance with the principles determined in this Regulation.

(2) Railway infrastructure operators and train operators create and publish train machinist patents in their safety management system and publish them on their own websites.

(3) Train driver's badge is given to the machinist as one original.

(4) The ownership of the train driver's license belongs to the institution or organization where the train driver works, where the badge is arranged.

(5) Railway infrastructure operators and train operators establish a registry recording system in which the train mechanic badge information they organize is stored.

(6) Railway infrastructure operators and train operators shall submit all information regarding the train driver's license issued to the Ministry at the latest within five working days upon request.

Exceptional situations

ARTICLE 12 - (1) In the following exceptional cases; It is not required for the train mechanic to have a train mechanic badge for the infrastructure and traction vehicle to be transported and managed at the maximum speed determined by the infrastructure operator.

a) Due to a malfunction detected by the railway infrastructure operator, on the changed course of trains or on lines that are maintained and repaired,

b) In the introduction, testing or delivery of a new train set or locomotive,

c) On the national railway infrastructure network, in the exhibition, touristic and similar purposes of the trains of historical value,

ç) In the case of at least one machinist accompanying the train engineer's license regarding the relevant infrastructure and traction vehicle, in case of giving practical training and / or examinations to the people who want to become a train machinist,

d) A new line will be commissioned zamThe vehicle will be used under the supervision of an officer from the producer of the line and an officer from the relevant infrastructure company together with the mechanics who will use that line first. zamin moments.

(2) When the railway train operators encounter a situation stated in the first paragraph of this article, they inform the relevant infrastructure operator about the situation and the decision they made.

(3) A railway infrastructure operator does not have the authority to influence the decision of the railway train operator regarding the situations stated in the first paragraph of this article.

(4) In the case of at least one train driver who has a train driver's license for the relevant infrastructure and / or traction vehicle in the train driver's cabin, the situations stated in the first paragraph are not considered as exceptional cases.

Minimum requirements for arranging train driver's badge

ARTICLE 13 - (1) The persons to be issued a train driver badge must have the following conditions:

a) To have a valid train driver's license,

b) To be the employee of the railway infrastructure operator, the train operator or the firm that provides contractual services to these operators,

c) To be successful in an examination that measures the professional competencies related to the railway infrastructure to be used and / or the traction vehicle to be administered by the train specified in Annex-5 applied by a railway training and examination center authorized by the Ministry,

ç) To have been trained and document the parts of the safety management system used by the railway infrastructure operator or the train operator he is working for, which concerns the train mechanic.

Train driver's license authorization categories

ARTICLE 14 - (1) Train mechanic badge is organized in two categories indicating the scope of train mechanic authorization:

a) Category A: Passengers and / or freight trains

b) Category B: Those who drive railway vehicles other than passengers and / or freight trains.

(2) Railway infrastructure operators and train operators and the vehicle, which attracts the categories specified in the first paragraph of this article, creates sub-authorization categories according to the line segment and needs.

(3) A train mechanic may be authorized for one or more of the categories or sub-categories specified in the first paragraph of this article, if it meets the necessary conditions.

(4) In the event that a train mechanic gains new qualifications regarding infrastructure and traction vehicles as a result of training and examinations, the qualifications gained are processed by the railway infrastructure operator or train operators within five business days at the latest.

ARTICLE 15 - (1) The format of the train driver's badge is arranged according to the criteria given in Annex-6.

Train driver's badge validity

ARTICLE 16 - (1) In order for the train driver's license to continue to be valid, the train driver is zamMust pass the exams to be held at intervals:

a) Traction vehicle information: Every three years,

b) Infrastructure information, including route and operational rules: Every three years or after any break over the respective route for more than eighteen months.

(2) If the requirements stated in the first paragraph of this article are fulfilled, this situation is recorded on the registry records and on the train driver's badge.

(3) Railway infrastructure operators or train operators, a train mechanic working within their body; If he / she determines that he / she cannot meet the professional qualification requirements specified in this Regulation, he / she takes the following measures:

a) Suspend the train driver's badge of the relevant person indefinitely,

b) He / she does not give train driver to the trainer and manage until the minimum conditions are documented again.

(4) In the event that a train driver thinks that it poses an obstacle to performing his duty safely in terms of health and / or psychotechnics:

a) Notifies this situation to the railway infrastructure operator or train operator that he / she is working at,

b) The railway infrastructure operator or train operator who receives such information shall ensure that this mechanic undergoes the health and psycho-technical evaluations in Annex-1.

(5) The badge of the train driver, whose health condition is suspected, is suspended by the railway infrastructure operator or the train operator. Train delivery and administration duties are not given to the machinist without obtaining the medical board report and the psycho-technical evaluation report.

(6) In the event that the contract of the train mechanic terminates for any reason, the validity of the train mechanic badge expires.

(7) If the persons working as a train mechanic under a service contract do not perform the transportation and management of any train for eighteen months, the validity of the train mechanic license expires even if the service contract continues.

Termination of the train engineer's work contract

ARTICLE 17 - (1) Railway infrastructure operators and train operators notify the Ministry in writing within five working days of the employment of a train mechanic employed by them or working for their own name within the scope of a service contract.

(2) If the machinist's employment contract is terminated, the enterprise where the machinist works is issued to the person whose employment contract is terminated by editing the following documents:

a) Copy of certified train driver's badge defined in Article 18.

b) A copy of all documents documenting all the trainings, competencies and train driving experience that the machinist has completed during his employment.

(3) The railway train operator or infrastructure operator can take measures to ensure that another railway train operator or infrastructure operator does not benefit unfairly if the driver voluntarily leaves his investments to train a driver.

Certified train driver copy

ARTICLE 18 - (1) The format conditions that the railway infrastructure operators or train operators will follow when arranging the copy of the approved train mechanic copy are given in Annex-6.

(2) The train driver requested during his tenure zamAt the moment, an approved train driver can request a copy of the certificate from the institution he works for. Railway infrastructure operators or railway train operators are obliged to issue an approved train driver's badge within five working days from the date of request and give it to the mechanic.

(3) Approved train driver's copy of copyrighted property belongs to real person.

(4) The certified train driver license copy does not authorize the train driver to use the relevant infrastructure or to drive and manage the relevant train.

(5) The copy of the approved train mechanic badge cannot be used instead of the original of the train mechanic badge in the document inspections carried out by the Ministry.

(6) If the train mechanic whose employment contract has ended is employed by another railway infrastructure operator or train operator, his new employer takes into account the information in the form of a certified train mechanic badge.

SECTION FIVE

Professional Competencies

Gaining and following professional competencies

ARTICLE 19 - (1) Railway infrastructure operators and train operators are responsible for gaining the professional qualifications specified in this Regulation and monitoring the status of these qualifications, as a minimum, for the train mechanic they employ or work under a service contract.

(2) Railway infrastructure operators and train operators establish the registration system in the safety management system to keep the professional competencies gained by the train driver, their trainings and the exam information they enter.

Railroad training and examination center

ARTICLE 20 - (1) Train driver's license and / or train driver's trainer training is given by the railway training and examination center authorized by the Ministry.

(2) Train driver's license exam is administered by the Ministry and / or the railway examination center authorized by the Ministry.

(3) Train driver's badge exam is administered by the railway training and examination center authorized by the Ministry.

(4) The procedures and principles regarding the qualifications of the railway training and examination center are determined by the Ministry.

Train driver working hours

ARTICLE 21 X (1) Railway infrastructure operators, railway train operators and train engineers of 22/5/2003 and the Labor Law No. 4857 and / or Regulation of the Public Economic Enterprises Personnel Regime No. 22 dated 1/1990/399 and Some Articles of the Decree Law No. 233 It complies with the following working principles, provided that it is not in violation of the regulations in the Decree Law on Repeal:

a) Train drivers; Except for train delivery and delivery times, it can be operated for a maximum of 9 hours at a time, by actually using the traction vehicle. Except for safety, accident, derailment, breakdown, road closure and natural disasters, it can be operated for a maximum of 11 hours in case of train delays,

b) Train engineers are given a minimum of 8 hours of rest at the end of the maximum working hour at a time,

c) Train driver working hours are a seven-day zamIt is arranged in such a way that a week holiday is given for at least 24 uninterrupted hours within the moment.

CHAPTER SIX

Audit, Administrative and Criminal Sanctions

Audit

ARTICLE 22 - (1) The Ministry supervises train engineers, railway infrastructure operators and train operators within the framework of the principles specified in this Regulation.

(2) Train drivers, railway infrastructure operators and train operators are obliged to submit all information and documents regarding the train driver's license, train driver license, health and trainings during the inspection process.

Administrative and penal sanctions

ARTICLE 23 - (1) If a train mechanic is unable to present the train driver's license and the original of the train driver's bureau during the inspections carried out, by the General Manager of Railway Regulation or the personnel authorized by the Railway Regulatory Authority within the framework of Article 655 of the Decree Law no. 28 5.000 (five thousand) Turkish Lira administrative fines decision minutes are issued.

(2) Except for the situation stated in the first paragraph of this article, in case of violation of the issues specified in this Regulation, an infrastructure operator or a railway train operator, for each audit, within the framework of Article 655 of the Decree Law No. 28, to the infrastructure operator or railway train operator. 10.000 (ten thousand) Turkish Lira administrative fine decision minutes is issued by the General Manager of Regulations or authorized personnel.

(3) The fines envisaged in this Regulation do not prevent the implementation of administrative sanctions such as suspension and cancellation regulated in this Regulation.

CHAPTER SEVEN

Miscellaneous and Final Provisions

Compliance with European Union legislation

ARTICLE 24 - (1) In the preparation of this Regulation, the European Parliament and the Council Directive were taken into account on the certification of train drivers operating locomotives and trains in the railway system in the Community numbered 23/10 / EC dated 2007/2007/59.

Update of monetary values ​​and administrative penalty amounts

ARTICLE 25 - (1) Monetary amounts and administrative fines in this Regulation are applied by increasing the revaluation rate determined and announced in accordance with the Tax Procedure Law dated 4/1/1961 and numbered 213 in relation to the previous year.

Train mechanic driver's license of the train mechanic working at TCDD

PROVISIONAL ARTICLE 1 - (1) Before the enactment of this Regulation, TCDD and TCDD Taşımacılık A.Ş. Train driver's license is arranged free of charge in case of applying to the Ministry by documenting that it has passed the health and psychotechnical evaluations specified in Annex-7 within the valid periods in the second paragraph of Article 1 or those who work as a train machinist or retired within the body of other railway operators. .

Train mechanic badge of train mechanic working in TCDD

PROVISIONAL ARTICLE 2 - (1) Before the enactment of this Regulation, TCDD and TCDD Taşımacılık A.Ş. and the trainers working within the body of other railway operators, the experience they have gained, the trainings they have received, the exams they have been successful in, and the examinations they have passed on, provided that they are certified, the institutions they work in arranging the train driver's badge specified in this Regulation.

Application method until the authorization of health and psychotechnical assessment centers

PROVISIONAL ARTICLE 3 - (1) Until the authorization of TCDD and railway train operators health and psychotechnical evaluation centers, the health and psychotechnical evaluations of the machinists are carried out in accordance with the existing legislation of TCDD or TCDD Taşımacılık A.Ş.

Force

ARTICLE 26 - (1) This Regulation shall enter into force on the date of its publication.

Executive

ARTICLE 27 - (1) The Minister of Transport, Maritime Affairs and Communications executes the provisions of this Regulation.

Requirements for Taking a Train Driver's License

REGULATION ON AMENDMENTS TO THE TRAIN MECHANIST REGULATION (18 May 2019)

ARTICLE 1 - Article 31 of the Train Machinist Regulation published in the Official Gazette dated 12/2016/29935 and numbered 2 has been amended as follows.

"ARTICLE 2 - (1) This Regulation; Paragraphs (a) and (d) of the first paragraph of Article 10 of the Presidential Decree No. 7 published in the Official Gazette dated 2018/30474/1 and numbered 478, and Some Regarding the Transportation and Infrastructure Area no. 26 of 9/2011/655 It was prepared on the basis of Article 28 of the Decree Law on Regulations. ”

ARTICLE 2 - Paragraphs (a), (b) and (o) of the first paragraph of Article 3 of the same Regulation have been amended as follows and the phrase "to work" in item (n) has been changed to "profession".

ARTICLE 3 - The third paragraph of Article 4 of the same Regulation has been amended as follows and the following paragraphs are added to the same article.

“(3) Railway train operators and infrastructure operators are responsible for keeping track of the train mechanic they employ or run under a service contract, creating a record system related to this, and establishing a data sharing system with the Ministry.”

“(4) The train driver's license also replaces the personal safety certificate. There is no need to issue a personal safety certificate to the train driver. However, the trainings and certificates to be taken within the scope of the personal safety document are added to the certificate.

(5) Of the personnel working as train engineers, those who will carry dangerous goods must have a certificate in accordance with the issues specified in the Training Directive on the Transport of Dangerous Goods by Rail.

ARTICLE 4 - 5 of the same Regulation, together with the title, has been changed as follows.

"Minimum requirements and documents required to obtain a driver's license

ARTICLE 5 - (1) The conditions to be provided for the first time by the profession for getting a train engineer license are as follows:

a) to have completed the age of twenty on the date of application.

b) Two biometric photographs of the last six months from the date of application.

c) Medical board report documenting that it meets the health conditions specified in Annex-1.

ç) Report received from the laboratory authorized by the Ministry of Health, indicating a “negative” result from the drug and stimulant test.

d) Psychotechnical evaluation report taken from the psychotechnical evaluation center authorized by the Ministry of Health in accordance with the procedures and principles in Annex-2.

(e) The document indicating that the driver's license fee was deposited.

f) In cases where it is an accredited certification body, to have the professional qualification certificate of the VQA valid in the Train Engineer National Qualification.

g) In cases where there is no authorized certification body; A railway examination authorized by the Ministry or the Ministry, from a railway training center authorized by the Ministry, having successfully completed the train mechanic basic training program, organized in accordance with the issues specified in the national qualification and professional standards of the train mechanic, and no more than twelve months before the application date. To get at least 100 (seventy) points out of 70 (hundred) from the proficiency exam administered in the center. ”

ARTICLE 5 - In the second paragraph of Article 6 of the same Regulation, the phrase "holder of VQA professional competence certificate valid for train driver national competence" has been changed to "within the principles of this Regulation" and the fifth paragraph has been changed as follows.

ARTICLE 6 - Article 7 of the same Regulation is amended as follows.

"ARTICLE 7 - (1) Train engineer's license is valid for ten years if the original documents are submitted to the Ministry:

a) Certificate of mastership and / or graduation for those who are exempt from MYK Vocational Qualification Certificate within the second paragraph of the provisional 1.

b) VQA vocational qualification certificate, which is not exempt from the VQA professional qualification certificate.

c) Medical board report taken in accordance with the periods specified in Annex-1.

ç) Psychotechnical evaluation report taken in accordance with the periods specified in Annex-2.

(2) Vocational qualification certificate of VQA obtained within the scope of subparagraph (b) of the first paragraph in accordance with the VQA legislation is renewed within the validity period of the train driver's license. ”

ARTICLE 7 - 8 of the same Regulation is amended as follows.

"ARTICLE 8 - (1) The conditions specified in subparagraphs (b), (c) and (ç) of the first paragraph of Article 7 are not met and / or renewal trainings at intervals determined in the safety management system of the enterprise zamIn the event that it is determined during the inspections to be carried out by the Ministry, the following process is initiated:

a) The Ministry shall notify the license holder and the holder of the license in writing, in writing, and suspend the validity of the license indefinitely.

b) The trainer's vehicle may not be assigned by the authority to which the driver is suspended. If the conditions specified in this paragraph are from the employer, the employer shall bear the financial losses that will occur during the suspension of the mechanic's license.

(2) In case the conditions specified in the first paragraph are met again, the suspension of the driver's license will cease.

(3) The license of the train mechanic is canceled by the Ministry for two years in case it causes serious accident, provided that it is documented by the judicial authorities that it is completely defective. The time taken from the post after the incident occurred is taken into account in this case. However, the machinist whose license has been canceled must renew the points in paragraphs (b), (c) and (ç) of the first paragraph of Article 7 as of the end of the cancellation period. ”

ARTICLE 8 - The subparagraph (a) of the first paragraph of Article 9 of the same Regulation and subparagraph (b) of the third paragraph shall be amended as follows.

“A) Ten years have passed since the date of issue,”

"B) Documents that have expired from the periodical documents specified in Article 7,"

ARTICLE 9 - The paragraphs (d) and (d) of the first paragraph of Article 12 of the same Regulation are amended as follows.

"Ç) In the case of at least one machinist accompanying the train driver license for the relevant infrastructure and traction vehicle, in the case of practical training and / or examination under the control of the training and examination center authorized by the Ministry for those who want to become a train mechanic,"

ARTICLE 10 - Clauses (a) and (b) of the first paragraph of Article 16 of the same Regulation have been changed as follows.

"A) Traction vehicle information: Every five years or every new vehicle is put into use,"

"B) Infrastructure information, including route and operating rules: Every five years or when a new line is opened or after any break over the given route for more than eighteen months."

ARTICLE 11 - The second paragraph of Article 22 of the same Regulation is amended as follows.

"(2) Train drivers, railway infrastructure operators and train operators are obliged to submit all information and documents regarding the train driver license, train driver license and trainings requested during the inspection process."

ARTICLE 12 - The first paragraph of Article 23 of the same Regulation is amended as follows.

“(1) If a train mechanic fails to present the train driver's license and the original of the train driver's bureau during the inspections, the General Directorate of Railway Regulation by the General Directorate of Railway Regulation, under the Article 655 of the Decree No. 28, by the Railway Operator to the train operator. five thousand) Turkish Lira administrative fines decision minutes are issued. ”

ARTICLE 13 - The provisional 1 of the same Regulation is amended as follows.

The health board report and the psychotechnical assessment reports, which have been taken before the date of entry into force of this Regulation and whose validity period continues, shall also be accepted.

(2) TCDD and TCDD Taşımacılık A.Ş. before the publication of the Communiqué on the Occupational Competence Institution Vocational Qualification Certificate Obligation (Rank No: 26/9) published by VQA in the Official Gazette dated 2017/30192/2017 and numbered 1. . Graduates from those working as a train machinist or retired from other railway operators and those who have retired from vocational and technical education schools and universities and departments of vocational and technical education affiliated to the Ministry of National Education, according to the Vocational Education Law No. 5 dated 6/1986/3308. Vocational Qualification Certificate from VQA candidates is not required. However, the applicants are obliged to submit the documents in paragraphs (ç) and (e) of the first paragraph of Article 5. ”

ARTICLE 14 - The provisional 2 of the same Regulation, together with the title, has been amended as follows.

"Train Engineer's Train Mechanic Badge

PROVISIONAL ARTICLE 2 - (1) TCDD and TCDD Taşımacılık A.Ş., which did not interrupt for any reason for eighteen months before the entry into force of this Regulation. and the train of the train machinists working with other railway operators, and the certificate of the traction vehicle used by the company for the one-time line, provided that the experience they have gained, the trainings they have received, and the exams they have passed are documented. ”

ARTICLE 15 - The provisional 3 of the same Regulation, together with its title, has been amended as follows.

"Trainer's psychotechnical controls

PROVISIONAL ARTICLE 3 - (1) TCDD and TCDD Taşımacılık A.Ş. and psychotechnical evaluations of train mechanics who work or will work in railway train operators; TCDD and TCDD Taşımacılık A.Ş. for five years until the authorization of psychotechnical evaluation centers. and other railway operators in accordance with the current legislation. ”

ARTICLE 16 - Article 26 of the same Regulation is amended as follows.

"ARTICLE 26 - (1) This Regulation, prepared jointly by the Ministry of Transport and Infrastructure and the Ministry of Health, enters into force on the date of its publication. ”

ARTICLE 17 - Article 27 of the same Regulation is amended as follows.

ARTICLE 18 - Annex-1 and Annex-2 of the same Regulation are amended as attached.

ARTICLE 19 - This Regulation, prepared jointly by the Ministry of Transport and Infrastructure and the Ministry of Health, shall enter into force on the date of publication.

ARTICLE 20 - The provisions of this Regulation are executed by the Minister of Transport and Infrastructure.
